Terms and Conditions of Booking
This agreement sets forth the Terms and Conditions that govern all bookings made through Mauritius Discoveries (hereinafter “we,” “us,” or “the Company”). By booking a trip, tour, or activity (“Service”) with us, you (“the Customer”) accept these Terms and Conditions.
1. Booking and Confirmation
1.1 Accuracy of Information
The Customer is responsible for providing complete and accurate information during the booking process, including names, contact details, and dates. We are not responsible for errors arising from incorrect information provided by the Customer.
1.2 Reservation
A reservation is considered confirmed only upon our receipt of the full payment or, if applicable, the agreed-upon deposit, and when we have issued a formal confirmation email or booking voucher.
2. Payments and Pricing
2.1 Pricing
All prices are quoted in the currency specified on the website (usually Mauritian Rupees – MUR, or a foreign equivalent like USD/EUR). Prices are subject to change without notice until the booking is confirmed.
2.2 Payment Gateway
We use the secure Mauritius Commercial Bank (MCB) Payment Gateway to process all online payments. By submitting payment information, you authorize us to charge the full cost of the Service to your provided card.
2.3 Inclusions and Exclusions
The price includes only those services explicitly mentioned in the “Inclusions” section of the respective trip itinerary. Items such as personal insurance, meals (unless specified), entrance fees (unless specified), and personal expenses are excluded unless otherwise noted.
3. Cancellation and Refunds
This section supersedes any information provided verbally and is binding upon booking.
3.1 Cancellation by the Customer
(Note: This aligns with the FAQ policy we drafted.)
- 100% Full Refund: If you cancel your trip within 48 hours of the initial time of booking.
- 50% Refund Policy: If you cancel your trip more than 48 hours after the initial time of booking, you will receive a 50% refund of the total trip cost.
- No Refund (0%): Cancellations made within 24 hours of the scheduled trip start time, or any no-show on the day of the activity, are non-refundable.
3.2 Cancellation by Mauritius Discoveries
We reserve the right to cancel any Service due to factors outside our control, including but not limited to:
- Unsafe Weather Conditions: Full refund or rescheduling offered.
- Force Majeure: Events such as natural disasters, civil unrest, or government restrictions. In such cases, a refund will be offered, subject to non-recoverable costs incurred by us.
4. Trip Participation and Conduct
4.1 Safety and Responsibility
The Customer acknowledges that participation in certain tours (especially adventure activities) involves inherent risks. The Customer assumes full responsibility for their personal safety and conduct.
4.2 Compliance with Instructions
The Customer must comply with all instructions given by the guide, driver, or staff regarding safety, conduct, and local laws. We reserve the right to refuse service or remove a Customer from a tour if their behavior is disruptive, violates local law, or endangers themselves or others, without any refund.
4.3 Age and Health Restrictions
The Customer must accurately confirm they and all members of their party meet any specified age limits or physical requirements detailed on the trip page. Failure to meet these requirements upon arrival may result in refusal of service without refund.
5. Liability and Insurance
5.1 Our Liability
We act as an agent for local operators and service providers. Our liability for any loss, damage, or injury during a trip is limited to the extent permitted by Mauritian law. We are not liable for any failure or delay in performance that results from a Force Majeure event.
5.2 Personal Travel Insurance (Mandatory Recommendation)
We strongly recommend that all Customers purchase comprehensive travel insurance at the time of booking. This insurance should cover, at a minimum, cancellation costs, medical expenses, personal accident, and loss of luggage/personal property.
6. Governing Law
This agreement is governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
